(1) If the person holding a public position does not submit an explanation within the time limit of sub-section (1) of Section 11 or if the explanation submitted by him is not satisfactory to the Commission, the Commission may send a written notice to the authority to warn him or to disclose the reason and grounds according to the amount of the offence.
(2) If written as per sub-section (1), the relevant authority shall propose a suitable punishment and take departmental action within three months according to the prevailing law and inform the Commission thereof. If an action has been initiated based on someone's complaint, the complainant should also be informed about it.
(3) If the relevant authority does not take departmental action within the time limit sent in writing according to sub-section (2), except for reasonable cause, the commission may take action as if he has committed an improper act according to this Act.
